Content Removal: Forms Alert reserves the right, but not the obligation, to remove, edit, or refuse to display any content that we, in our sole discretion, determine to be harmful, offensive, illegal, or in violation of these terms, without prior notice.

• Damages arising from fraudulent job postings, scams, or malicious links
• Damages resulting from use or inability to use the Service

• Damages resulting from third-party conduct, including but not limited to fraud, misrepresentation, or illegal activities
• Any other damages arising from your use of or reliance on the Service or any information, links, or content provided therein

Total Liability Cap: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY of Forms Alert Parties for all claims, damages, losses, or causes of action arising out of or relating to the Service or these terms, whether in contract, tort (including negligence), strict liability, or otherwise, SHALL NOT EXCEED THE AMOUNT YOU PAID TO Forms Alert, IF ANY, FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED RUPEES (₹100), WHICHEVER IS GREATER.

INDEMNIFICATION: YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS Forms Alert Parties from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service
• Your violation of these Terms of Service or Privacy Policy
• Your violation of any applicable laws, regulations, or third-party rights
• Your submission, posting, or transmission of any user-generated content
• Your interaction with any third-party websites, services, recruiters, or employers accessed through the Service
• Any fraud, misrepresentation, or illegal activity you engage in or are alleged to have engaged in

No Responsibility for Third-Party Actions: Forms Alert Parties shall have no liability or responsibility for any actions, omissions, conduct, statements, representations, warranties, or guarantees made by any third parties, including but not limited to employers, recruiters, job posting platforms (LinkedIn, Naukri, Indeed, etc.), or any other third-party service providers. You acknowledge and agree that any interactions, transactions, or relationships with such third parties are solely between you and such third parties, and Forms Alert shall not be responsible or liable for any losses or damages arising therefrom.

Ownership: The Service, including but not limited to its design, text, graphics, logos, icons, images, software, and other materials, is owned by Forms Alert or its licensors and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent from Forms Alert.

Third-Party Content: The Service may display, link to, or provide access to content, information, services, products, or materials from third parties, including but not limited to job postings from LinkedIn, Naukri, Indeed, company websites, and other platforms. Forms Alert does not own, control, endorse, verify, or validate any such third-party content. All third-party content is provided for informational purposes only, and Forms Alert makes no representations or warranties regarding the accuracy, completeness, authenticity, legality, or safety of such third-party content.

Trademark Notice: All trademarks, service marks, and trade names appearing on the Service are the property of their respective owners. The mention of any third-party trademarks, service marks, or trade names does not imply endorsement by Forms Alert or vice versa. Forms Alert's trademarks and trade dress may not be used without our prior written permission.

Any disputes arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.

Dispute Resolution: Before initiating any legal proceedings, you agree to first contact us at support@formalert.in to attempt to resolve any disputes informally. If we cannot resolve the dispute informally within sixty (60) days, you agree that any disputes, claims, or controversies arising out of or relating to these terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015, except where prohibited by law.

Class Action Waiver: You agree that any disputes shall be resolved on an individual basis and waive your right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against Forms Alert.

Severability: If any provision of these Terms of Service or Privacy Policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions shall remain in full force and effect.

Force Majeure: Forms Alert shall not be liable for any failure or delay in performance under these terms that is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or equipment failures, internet outages, power failures, or other causes beyond our reasonable control.

Waiver: No waiver by Forms Alert of any term or condition set forth in these Terms of Service or Privacy Policy shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Forms Alert to assert a right or provision under these terms shall not constitute a waiver of such right or provision.

Entire Agreement: These Terms of Service and Privacy Policy constitute the entire agreement between you and Forms Alert regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, relating to the subject matter hereof.
